FitBike – Terms & Conditions of Use

Click-wrap acceptance: By creating an account or using FitBike, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the Service. To receive SMS alerts, you must separately consent as described in our SMS Program and SMS Terms.

1. Overview of the Service

FitBike helps cyclists track mileage and receive maintenance reminders (e.g., tires, brakes, chain, suspension). The Service is informational only and depends on third-party integrations (e.g., Strava) and messaging providers (email/SMS). FitBike currently does not charge fees.

2. Eligibility & Accounts

You must be at least 13 years old to use the Service. You are responsible for your account and for keeping your credentials secure.

3. Consent to Terms; Separate Consent for SMS

By clicking “Create Account” or similar, you accept these Terms and the Privacy Policy. SMS messaging is optional and requires separate opt-in (checkbox). You can opt out any time as described in the SMS Terms.

You retain your rights in content you submit. You grant FitBike a non-exclusive, worldwide, royalty-free license to use that content solely to provide and improve the Service. You represent you have necessary rights to content you provide.

7. Intellectual Property

FitBike’s code, content, and logos are protected by copyright, trademark, and other laws. Except as expressly permitted, all rights are reserved.

FitBike may link to or integrate with third-party services (e.g., Strava, email/SMS carriers). FitBike is not responsible for third-party content, availability, or policies. Your use of third-party services is at your own risk and may be subject to their terms.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITBIKE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FITBIKE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ACCURATE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITBIKE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. FITBIKE’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNTS YOU PAID TO FITBIKE IN THE 12 MONTHS BEFORE THE CLAIM (IF ANY).

12. Indemnification

You agree to defend, indemnify, and hold harmless FitBike and its affiliates from and against claims and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service or violation of these Terms.

13. Termination

You may stop using the Service at any time. We may suspend or terminate access with or without notice if we believe you violated these Terms or for operational/security reasons. Sections intended to survive (e.g., Disclaimers, Limitation of Liability) will survive termination.

14. Changes to the Service and Terms

We may modify the Service or these Terms at any time. Material changes will be posted with a new “Last Updated” date. Continued use after changes means you accept the updated Terms.

15. Governing Law; Venue

These Terms are governed by the laws of the State of California (without regard to conflict of laws). You consent to exclusive jurisdiction and venue in the state and federal courts located in Nevada County, California, for disputes not subject to arbitration.

The Service is not directed to children under 13. Do not use the Service or provide personal data if you are under 13.

Please review our Privacy Policy for how we collect, use, and safeguard personal information (e.g., name, email, phone number, Strava data). By using the Service, you consent to the practices described there.
